Contracts, Claims and Disputes

PMCC provides various services within the contracts, claims and disputes field.

Construction Contracts

PMCC services for construction contracts start at the very beginning of contract formation by providing advice on the best form of contract to use in order to meet with client requirements. From this early advice we assist in contract reviews to deal with specific project or client requirements to ensure that construction contracts are robust in nature and protect the key interests that the client has. If another party is forming the contract and issuing for review, PMCC will provide contract review services of the same, identifying possible amendments and the key risks, rights and obligations of the Contract.


Upon award, PMCC will provide contract administration services for the project and issue necessary letters/notices to ensure that rights are maintained and obligations are confirmed.

Construction Claims


As a specialised construction claims consultant, we prepare well-strategized and considered contract claims to ensure that our clients take the best route forward and provide the best opportunity to deliver a successful result from construction claims. Our claims include for extensions of time (EOT), loss and expense, disruption, loss of profit, and acceleration measures.


Our delivered product is clear, well thought out, and provides for a robust and evidenced construction claim product for negotiations and discussions with opposing parties.

Construction Disputes


PMCC assist in resolving disputes in the form of an independent role or as advocate for a party. In terms of independent roles PMCC provided Independent Expert Witness services on Quantum and Delay for adjudications, arbitrations, winding up orders and civil legal proceedings during formal disputes. PMCC also however provide alternative dispute resolution services including mediation.


In terms of a party advocate we provide strategy and direction to legal teams during formal legal proceedings particularly in strategizing and preparing formal documentations and submissions for the proceedings including arbitration, adjudication and civil proceedings.


PMCC also provides assistance with clients during ADR methods including Mediation and Adjudication via the Construction Industry Payment Adjudication Act (CIPAA).

Commercial Management

PMCC provide a vast array of commercial management services for our clients across the industry spectrum.

These services commence from initial project idea, whereby PMCC provide high level financial advice on an initial business ideas or initial project advisory. We then develop with our clients their project feasibility report and outline budgets for the initial business proposal or project idea.

During design stage we provide value engineering services to analyse design solutions, materials and specifications to ensure that we are achieving the performance requirements of the same at optimal efficient costs.

Our commercial management services include procurement of main contractors, key contractors and all the way through to detailed trade contractors or trade suppliers. PMCC strategise the best procurement options against the clients requirements, then plan, action and monitor the same until conclusion of the project procurement.

For tendering contractor clients PMCC will provide full remeasurement of tender documents in order that bidding contractors have confidence as to the scope and extent of their works and as such limiting risks related to these matters in lump sum bid submissions.

Through the development of the project PMCC will support in terms of commercial forecasting, commercial controls and management of the same through projects to ensure robust forecasting takes place and that forecast margins are achieved. In addition PMCC will provide verification of quantities and variation management and valuation throughout until final accounting.

Engineering, Procurement and Construction Management (EPCM)

EPCM – Engineering, Procurement, Construction Management is one of PMCC’s prime service. We cover the entire EPC project life cycle and manage each trade based on international standards with highly experienced individuals specifically selected for your project. Based on our EPC experience such projects are usually managed as a programme of individual sub-projects with a consolidated benefit as an outcome. We apply the best practises and tailor the individual trade to amalgamate it into a programme with processes from the very start until the very completion.

We can be in the role of a PMC, PDP or just specific subject matter expert for the project owner, the main EPC contractor, or sub-contractors.

For the engineering phase, we deliver requirement management, engineering management, interface management, risk management, systems assurance and integration with other trades, packages, and environment. The procurement phase is overlapping with all project phases as it must be established at the start of the project for tendering, contract setup, long lead items, material approvals, risk management and ultimately the setup of the progress tracking for the regular claims with quantity surveying.

All that leads into the construction management to mobilise the teams and machinery to the site with prior safety setup, training, and the approved design drawings for construction at the right time at the right place in the right hands to expedite the works. Deliver EPC Management with a comprehensive timeline, tracking system, quality management and process setup, documentation, and the right team to set all in motion.

We have done numerous projects and been in different roles to expedite the programme with our team actively to take all the actions, manage sub-contractors and their deliverables, attend upstream and downstream meetings and ultimately report the progress on a weekly and monthly basis upstream to the Project Director and Board of Directors.

Requirement Management

PMCC ensures project success by embedding a powerful requirement management technique that is applicable for various projects in different industries. These approaches are diligently tailored to serve specific project needs.

A requirement management plan develop the strategy from its foundation to its execution that would define how you would receive, analyse, document and manage all the requirement within the project. In the plan, the key resources are identified within the project team including with the contractors and the client.

We will support on administrating review session with the client, suppliers and the contractors. From these review session, the audit schedules are arranged with the independent assessors which the entire process shall be established to ensure it is communicated well with external and internal stakeholders.

We will then move into Exploring, Identifying, Documenting all the requirements from the contractual document and tagging them against each project lifecycle. A tracker shall be used to monitor, control, and verify the content of the requirement against the contractual deliverables. Any gaps that were found shall be communicated formally to the client.

In some cases, a change request management required, which we will build the structure, and derive the process that is aligned with the project standards. We will support in administrating and managing the change request process.

To ensure that full compliance to the contractual deliverables, we will also ensure the submission of all document from the design stage, construction, testing & commissioning and handover captures the traceability of the requirements. We will also validate the deliverables of the requirement either through reports, test results, and also operational documentation.

Our team are trained to use the requirement management tools such as ComplyPro, Doors, etc to login the requirement, including building the traceability matrix, and as such able to provide the complete package to your project.

Planning

Planning Feasibility

From the very initial project idea, we create a robust and reliable programme for carrying out a project.

Then, we assess and review tender programmes as to practicality, logic, and realistic time period for carrying out the works.

In addition, perform third-party programme auditing to identify issues and provide programme assurance.

Client Project Programming

We develop the initial programme as the design progresses in terms of constructability and detailing.

Additionally, reviewing contractor’s baseline programme on its logic, productivity outputs, the realism of the project, and compliance with the contractual obligations.

As well as reviewing progress onsite, contractors’ progress updates and progress reports providing independent analysis and ensuring accuracy.

In order to maintain and complete the project on time, we also prepare mitigation/acceleration options to deal with events of delay.

Contractor Project Programming

We tender programme preparation to ensure the ability to deliver the project in the period stated within tender documents.

We also prepare baseline programme for the works, with sensible logic, realistic productivity outputs, and compliance with the contractual obligations.

On top of reviewing progress onsite, preparing regular progress updates and progress reports, we prepare mitigation/acceleration options to deal with events of delay in order to maintain and complete the project on time.
